​A BILL to amend the Civil Aviation Act, Cap. 8.03.

BE IT ENACTED by the Queen’s Most ExcellentMajesty, by and with the advice and consent of theNational Assembly of Saint Christopher and Nevis, andby the authority of the same as follows:

1. Short title.

This Act may be cited as the Civil Aviation (Amendment) Act, 2019.

 

2. Interpretation.

In this Act, unless the context otherwise requires,

“Act“ means the Civil Aviation Act, Cap. 8.03.

3. Amendment of section 4.

The Act is amended in section 4 by replacing paragraph (k) as follows

“(k) for the purposes of protecting passengers, crew members, aircraft, air navigation facilities, aerodromes and other aviation facilities

(i) prevent unlawful interference with civil aviation and ensure that appropriate action is taken where that interference occurs or is likely to occur;
(ii) exercise enforcement powers to ensure compliance with national aviation security policies and requirements;”.

4. Amendment of section 41.

The Act is amended in section 41 subsection (1) by replacing paragraph (h) as follows

​“ (h) commit an act of unlawful interference, including ​

(i) unlawful seizure of aircraft;

(ii) an act of violence against a person on board an aircraft in flight, if that act is likely to endanger the safety of that aircraft;

(iii) an act of violence using any device, substance or weapon against a person at an airport serving international civil aviation, which causes or is likely to cause serious injury or death, if such an act endangers or is likely to endanger safety at that airport

(iv) destruction of, or serious damage to the facilities of, an airport serving international civil aviation or aircraft not in service located thereon, or disruption of the services of the airport, if such an act endangers or is likely to endanger safety at that airport;

(v) placing or causing to be placed on an aircraft in service, by any means whatsoever, a device or substance which is likely to destroy that aircraft, or to cause damage to it that renders it incapable of flight or that is likely to endanger its safety in flight;

(vi) destruction or damage to air navigation facilities or interference with their operation, if such an act is likely to endanger the safety of aircraft in flight;

(vii) communication of information which a person knows to be false, thereby endangering the safety of an aircraft in flight; or

(viii) unlawful interference with any aircraft, aerodrome or facilities provided for air navigation purposes.”.
