A BILL to amend the Immigration Act, Cap. 6.02.

BE IT ENACTED by the Queen’s Most Excellent Majesty, by and with the advice and consent of the National Assembly of Saint Christopher and Nevis and by the authority of the same as follows:

1. Short title.

This Act may be cited as the Immigration (Amendment) Act, 2021. 

2. Interpretation.      

In this Act, “Act” means the Immigration Act, Cap. 6.02.

3. Amendment of section 5.

The Act is amended in section 5 by inserting a new paragraph 5 (2) (b) (iv) as follows

            “(iv) is in employment on a full-time basis in a country other than Saint Christopher and Nevis and wishes to work remotely in Saint Christopher and Nevis for a maximum period of twelve months;”. 

4. Amendment of section 6.     

The Act is amended in section 6 by 

  • in paragraph (f), replacing the full stop with a semicolon;
  • inserting a new paragraph (g) immediately following paragraph (f) as follows

                        “(g)  digital resident.”.   

  • inserting new subsections (6) and (7) as follows

                        “(6)  Subject to the provisions of this Act and Regulations made under this Act a                           person may, on application made to the Minister in the form set out in the Eighth                               Schedule, be granted permission to become a digital resident of Saint Christopher                                 and Nevis, if he or she satisfies the requirements specified in subsection (7) and the                      Eighth Schedule.

                        (7) The person referred to in subsection (6) shall be a person who 

                                    (a)       wishes to work remotely in Saint Christopher and Nevis for a                                                             maximum period of twelve months and

                                                (i)        who is employed on a full-time basis in a country other than                                                  Saint Christopher and Nevis; and

                                                (ii)       who is employed by a company registered and operating                                                                   outside of Saint Christopher and Nevis;

                                    (b)       is not a citizen, an approved CARICOM citizen or a citizen of a                                                         Protocol Member State;

                                    (c)       is dependent on a principal applicant under this subsection.

5. Amendment of section 14.      

The Act is amended in section 14 by inserting a new subsection (9) as follows

“(9) Notwithstanding anything contained in this section, a digital resident, as long as such a person is not a prohibited person, shall be permitted to enter and remain in Saint Christopher and Nevis for a period of twelve months.”.

Digital Residents

1. Employment of domestic workers

A digital resident, referred to under section 6, may employ a person who is a citizen of Saint Christopher and Nevis, or an approved CARICOM citizen or a citizen of a Protocol Member State residing in Saint Christopher and Nevis, to work as a domestic worker or support staff.

2. Application for Digital Resident

(1) An applicant for digital residence shall make the application online while the person is outside of Saint Christopher and Nevis, except that this provision shall not apply in respect of an application for renewal of a digital residence or any other case as the Minister may, by Order, direct.

(2) There shall be paid in respect of an application for Digital Residence such fee as may be prescribed.

(3) Any person being a Digital Resident, who contravenes or fails to comply with any condition subject to which the permit was granted, commits an offence.

(4) The Minister may, at any time

            (a)       modify or cancel any condition specified in; or

            (b)       revoke, the Digital Residence.
