A BILL to amend the Freedom of Information Act, No. 6 of 2018. 

BE IT ENACTED by the King’s Most Excellent Majesty, by and with the advice and  consent of the National Assembly of Saint Christopher and Nevis, and by the authority of the  same as follows: 

1. Short title. 

This Act may be cited as the Freedom of Information (Amendment) Act, 2024. 

2. Interpretation. 

In this Act, unless the context otherwise requires, 

“Act” means the Freedom of Information Act, No. 6 of 2018. 

3. Amendment of section 2. 

The Act is amended in section 2 by adding the following new definitions in the correct  alphabetical order 

“ “Ombudsman” means Ombudsman appointed under section 4 of the Ombudsman Act,  Cap. 3.22; 

“Special Prosecutor” means the Special Prosecutor appointed under section 5 of the Anti Corruption Act, No. 5 of 2023;”. 

4. Amendment of section 35. 

The Act is amended in section 35— 

(a) by replacing subsection (2)(b) with the expression “holds or is acting in a public office  except if he or she is or is acting as the Ombudsman or the Special Prosecutor;”; and 

(b) by replacing subsection (3) with the expression “The Commissioner shall, subject to  the provision of this Part, hold office for a period not exceeding five years and shall  be eligible for re-appointment.”
