A BILL to amend the Public Parks Regulation Act, Cap. 23.24.

BE IT ENACTED by the King’s Most Excellent Majesty, by and with the advice and consent of the National Assembly of Saint Christopher and Nevis, and by the authority of the same as follows:

  1. Short title 

This Act may be cited as the Public Parks Regulation (Amendment) Act, 2024.

  1. Interpretation

In this Act—

“Act” means the Public Parks Regulation Act, Cap. 23.24.

  1. Amendment of section 2

The Act is amended in section 2 by—

(a) replacing the definition of the expression “Minister” with the following— 

“ “Minister” means the Prime Minister appointed pursuant to section 52(1) of the Constitution of Saint Christopher and Nevis; ”; 

(b) replacing the definition of the expression “park-keeper” with the following definition—

“park-keeper” or “keeper” means any person appointed to be a keeper of a public park”;

(c) deleting the definition of the expression “Public-Parks” and replacing that expression wherever it occurs with the expression, “public parks”.

  1. Amendment of section 6

Section 6 of the Act is amended by replacing it as follows— 

“6. Minister to declare public park.

  1. The Minister may declare any place to be a public park, by Order—

(a) in his or her own deliberate judgement; 

(b) in consultation with the Premier of Nevis, with respect to public parks in Nevis; or

(c) in consultation with any other Minister of Government of Saint Christopher and Nevis. 

  1. A place declared to be a park in accordance with the provisions of subsection (1) shall be managed and maintained in good condition by the relevant Ministry of the Government of Saint Christopher and Nevis or the relevant Ministry of the Nevis Island Administration stated in the declaration, in order to fulfil the purpose for which the place was declared to be a public park.  
  1. Amendment of Second Schedule.

The Second Schedule is amended as follows— 

(a) in paragraph 3 subparagraph (i) by replacing the expression, “keeper of the Recreation Ground” with the expression, “park-keeper”; and

(b) by replacing the expression “keeper of the Recreation Ground”, wherever else it occurs in the Act, with the expression, “park-keeper”.

7. Amendment of Twenty-First Schedule

    The Act is amended in the Twenty-First Schedule by replacing in paragraph 3 subparagraph

    (i) the expression, “keeper of the Park” with the expression, “park-keeper”.
