A BILL to amend the Offences Against the Person Act, Cap. 4.21.
BE IT ENACTED by the King’s Most Excellent Majesty, by and with the advice and consent of the National Assembly of Saint Christopher and Nevis and by the authority of the same as follows—
1. Short Title.
This Act may be cited as the Offences Against the Person (Amendment) Act, 2024.
2. Interpretation.
In this Act, unless the context otherwise requires, “Act” means the Offences Against the Person Act, Cap. 4.21.
3. Amendment of section 13.
The Act is amended in section 13 by replacing the section as follows—
“13. Attempts to murder by drowning, suffocating, poisoning etc.
(1) Any person who attempts to drown, suffocate or strangle any person; administer to, cause to be administered to, or cause to be taken by any person, any poison or other destructive thing, with intent to commit murder, whether any bodily injury results from the attempt or not, commits a felony, and shall be liable on conviction on indictment to be imprisoned for life, with or without hard labour.
4. Amendment to add section 13A.
The Act is amended by inserting immediately after section 13, the following new section 13A, as follows—
“ 13A. Shooting or attempting to shoot with intent to murder.
Any person who—
(a) attempts to shoot at any person; or
(b) by drawing a trigger attempts to discharge any kind of loaded arms at any person; or (c) in any other manner attempts to discharge any kind of loaded arms at any person;

commits an offence and is liable on conviction on indictment to pay a fine not exceeding five hundred thousand dollars or to be imprisoned for life, with or without hard labour, or to both. ”
5. Amendment of section 17.
The Act is amended in section 17, by deleting the expression, “on conviction, shall be liable to be imprisoned for a term not exceeding twenty years, with or without hard labour” and replacing it with the expression, “on conviction on indictment, shall be liable to pay a fine not exceeding five hundred thousand dollars or to be imprisoned, with or without hard labour, for a term not exceeding forty years, or to both.”
