A BILL to amend the Title by Registration Act Cap. 10.19.

BE IT ENACTED by the Queen’s Most Excellent Majesty, by and with the advice and consent of the National Assembly of Saint Christopher and Nevis and by the authority of the same as follows:

1. Short title.

This Act may be cited as the Title by Registration (Amendment) Act, 2017.

2. Interpretation.

In this Act, unless the context otherwise requires, “Act” means the Title by Registration Act Cap. 10.19.

3. Amendment of section 3.

The Act is amended in section 3 subsection (2), by deleting, immediately after the expression “Circuit,” the expression, “with the approval of the Chief Justice as ex officio Keeper of the Records.”

 

4. Amendment of section 136.

The Act is amended in section 136 as follows:

 

  1. by replacing the heading “Registrars of High Court to be Registrars of Titles” with the heading, “Registrar of Titles”
  1. by replacing subsection (1) with the following:

“(1) The Registrar of Lands shall be the Registrar of Titles.”

5. Amendment of Act.

The Act is amended in section 160 by replacing the expression, “Governor-General”  with the expression, “Minister with responsibility for Justice.”

6. Amendment of section 169.

The Act is amended in section 169 as follows:

(a) by replacing the heading “Power to Chief Justice to make rules” with the heading, “Rules and Regulations”

(b) by repealing subsection (2) and substituting the following subsection:

“ (2)   Subject to subsection (1):

(a) the Chief Justice may make rules and orders for the purpose of giving effect to those provisions of this Act, which relate to the functions or powers of the Registrar of the High Court; and

(b)     the Minister may make regulations for the purpose of giving effect

to those provisions of this Act, which relate to the functions or powers of the Registrar of Titles.”

7. Amendment of First Schedule.

The Act is amended in the First Schedule as follows:

  1. by inserting the following definition in the correct alphabetical order:

“Registrar of Lands” means the Registrar of Lands appointed under section 7 of the Land Registry Act, No.    of  2017.”

  1. by deleting the following from the definition of “Registry”, the following expression:

“The Registries of the High Court in the several Circuits of the State shall be the several Registries of Titles to land situate in such Circuits.”
