A BILL to amend the Ombudsman Act, Cap. 3.22.
BE IT ENACTED by the King’s Most Excellent Majesty, by and with the advice and consent of the National Assembly of Saint Christopher and Nevis, and by the authority of the same as follows:
1. Short title.
This Act may be cited as the Ombudsman (Amendment) Act, 2023.
2. Interpretation.
In this Act, unless the context otherwise requires, Act means the Ombudsman Act, Cap. 3.22.
3. Amendment of section 5.
The Act is amended in section 5 by replacing subsections (1) and (2) with the following—
(1) The Ombudsman shall be appointed by instrument in writing and shall, subject to the provision of this Part, hold office for a period not exceeding five years and shall be eligible for re-appointment.
(2) A person appointed as Ombudsman shall be a person of high integrity, capable of exercising competence, diligence, sound judgment and impartiality in fulfilling his or her duties pursuant to the provisions of this Act.
4. Amendment of section 8.
The Act is amended in section 8 by replacing subsections (1) and (2) with the following—
(1) The Ombudsman shall receive such emoluments payable, from time to time, to a Permanent Secretary.
(2) The Ombudsman shall be entitled to the same pension and gratuity benefits payable to a Permanent Secretary.
